What is a Spousal Sponsorship Open Work Permit?

A Spousal Sponsorship Open Work Permit is a type of work authorization issued to individuals sponsored for permanent residence in Canada by their spouse or partner.

Unlike employer-specific permits, a SOWP allows you to:

  • Work for any employer
  • Work full-time or part-time
  • Gain valuable Canadian work experience while your permanent residence application is in process

Who Can Apply for a Spousal Sponsorship Open Work Permit?

To be eligible, you must:

  • Be the spouse, common-law partner, or conjugal partner of a Canadian citizen or permanent resident
  • Have submitted (or be included in) a spousal sponsorship application for permanent residence
  • Be living in Canada with your sponsor in a genuine relationship
  • Ideally hold a valid temporary resident status (visitor, student, or worker)

If You Don’t Have Status

You may still be eligible—but the process is different.

  • You must wait for Approval in Principle (AIP) before applying
  • You’ll need to submit a paper application with an explanation
  • Additional documentation may be required

What is Approval in Principle (AIP)?
This means your permanent residence application has passed initial eligibility checks but is still pending medical, criminal, and security clearances.

Immigration Tip💡

Dependent children included in your sponsorship application may also be eligible for open work permits.

Spousal Sponsorship Open Work Permit Processing Times

Processing times currently average 240 days, but can vary depending on application volume and individual circumstances.

To check the approximate processing time for a particular application, visit Canada’s dedicated webpage.

Immigration Tip💡

Submitting your open work permit together with your sponsorship application (if you have a valid status in Canada) can help avoid delays.

Spousal Sponsorship Open Work Permits Fees

  • $155 CAD – Work permit processing fee
  • $100 CAD – Open work permit holder fee

Total: $255 CAD

How long is a spousal sponsorship open work permit valid?

A SOWP is typically valid for up to two years, aligning with standard sponsorship processing timelines.

It can be extended if your permanent residence application is still in progress. Once you receive Canadian permanent residence, you will no longer need work authorization.

Immigration Tip💡

Your work permit will not be issued beyond your passport expiry date. Renew your passport before applying to avoid a shortened permit.

You can apply for an extension later, once you renew your passport, but it will be more efficient to renew your passport before applying.

Reasons Spousal Sponsorship Open Work Permits are Refused

Spousal open work permits can be refused for several reasons, including:

1. Living Outside Canada

You must be residing in Canada with your sponsor. Applications may be refused if:

  • You live abroad
  • You are not cohabiting

2. Insufficient Proof of Relationship

Applicants must demonstrate a genuine relationship. Weak or missing documentation may lead to refusal.

3. Status Issues

A lack of a valid status, without proper restoration or explanation, can negatively impact your application.
